Brief Description
This course aims to offer students a general primer on the ways in which technology poses challenges and offers opportunities for the law, both at the national and the transnational level. It exposes the disruptive effects of technology, discusses the ways in which it affects legal systems and makes them advance, while keeping a constant eye on the final user, the consumer of legal rules, the individual. It essentially covers aspects of public law, both from a regulatory and from a normative perspective. It is introductory, as it is addressed to non-lawyers.
Learning outcomes. At the end of the course, students should be able to:
- understand the ways in which technologies disrupt and may further disrupt legal systems and legal rules;
- appreciate the opportunities offered by technologies to advance legal systems
- understand the regulatory capabilities and limitations of national and supra-national entities;
- appreciate the ways in which technology may affect individuals, as consumers, workers, citizens, minority members etc;
- understand the struggle between open access and licensed access, between competition and IPRs, between the need for unfettered data flows and data protection
- realize the opportunities and threats posed by AI, both individually and collectively,
- acknowledge the ways in which technology can impact public administration
The course will be delivered in English and will be evaluated through students’ brief presentations (during the last two sessions) and the submission of the corresponding written papers, during exam period. There will be no actual exam.
Students are expected to have read the assigned readings BEFORE each session, in a way that makes them informed discussants. Participation in the lectures is highly welcome and strongly encouraged.
